good morning traffic and moving along relatively well. somewhat surprising how well it's looking. i don't want to jinx it or anything, but looks good into the city. westbound on the bridge and also on the lower deck between san francisco and oakland. also this morning, the san mateo bridge out to the high- rise looks good. and no way, jr. problems on 101 or 28 when you get there. back to dave and pam. the number of protesters ignoring the overnight curfew at oakland city hall is growing. several dozen are camped out this morning after a pretty tense late night appearance by the mayor of oakland. we are out there right now with the very latest. craig. >> reporter: yeah, dave, growing number of people who are camping out here, defying the 10:00 p.m. curfew. you saw the one tent yesterday. look how many are here this morning. and police nowhere to be seen, possible fallout from what

happened on tuesday night. but the mayor last night is definitely a direct result of tuesday's mayhem. >> go home! go home! . >> reporter: as a thousand people gathered, the mayor tried to offer an apology. it was rejected. the mayor had to flee into city hall. instead she issued this statement, we are deeply saddened about the outcome on tuesday. it was not what anyone had hoped for. ultimately, it was my responsibility and i apologize for what happened. he suffered a fractured skull tuesday night after being hit in the head with a projectile thrown from behind police lines. he is an iraqi war vet without being injured. and it is why some people say they have returned to the camp. >> breaks my heart. i mean, my son, my wife and i

basically had been crying for a couple of months. >> reporter: he isn't the only one who returned, dozens of other people decided to come back and pitch tents. these people will perhaps be the closest when michael moore arrivals. moore tweeted overnight that he intends to come to speaking to the assembled crowd here at the plaza. reporting thrive oakland, ktvu channel 2 news. well the occupy oakland protest has become a national story. and the oakland mayor is getting coast to coast criticism. a liberal tv host is among those outraged with the mayor's role in this week's police raid. >> the mayor is left with to choices, she can dismiss the acting police chief and use her powers to authorize occupy oakland to protest against without harassment. or having detrayed everything she supported and all those who supported her, she must resign.

were abruptly cancel yesterday. however the police chief says what appeared to be staging was nothing more than training. one supervisor says that was not the case. >> just be discuss realize it probably wasn't the best thing to do. and now we're at the table where they should be. >> we're toll that sometime tomorrow the mayor will announce plans for the plaza. another school threat will bring extra police to campus today. the latest threat is made the elementary school in pleasant hill. similar threats have been made throughout the school district. >> reporter: and that's exactly why pleasant hill police investigators are talking with police about this case to see if there's any similarities between the threat made between the schools and earlier threats made this week. now the school received the letter yesterday. and today they plan to have extra security at the school. we don't know the nature of the threat.

that's something police investigative unit will have to tell us more about when they get in later this morning. on wednesday, police said three schools in that city received threatening letters, making what police described only as graphic threats to children. they wouldn't get into more detailed informing about what the threats to those schools were. but several threats were made to schools in the county. this month, someone sent a fax to concord high school warning people there that someone would be shot the next day. luckily, that threat never materialized. but a week later, someone sent a threatening email warning of violence there. that same week, a fifth grader at a walnut creek elementary received a threatening drawing. here, the threat came by mail. parents have been made aware of the situation and they have been told that there might be extra security here at the school later on today.

ktvu channel 2 news. oakland police are investigating an overnight homicide. police responded to reports of gun fire at the intersection of myers and 109th avenue at about 11:15 last night. they found a man on the sidewalk with at least one gunshot wound and he was pronounced dead at the scene. now we don't know his name or age. and police have not yet released any suspect description or possible motive the case. the defense secretary says he's following orders and will cut buckingham palace of dollars from the defense budget. he says thousands of jobs connected to the defense industry could be at risk. coming up 5:69:15, a live report from the washington, d.c. news room. the company companies and the -- the defense companies here that could be affected. another hearing focusing on a company will take place next month. this time, the energy secretary will testify. republicans are expected to grill him over the half billion

dollars government loan awarded to that former company. you will recall he went bankrupt and laid off 1100 employees. back over to sal to check in on traffic. how does it look? >> looks good. as a matter of fact, we are doing very nicely. and many of these areas. as a matter of fact, i want to, i also want to mention the control room that my maps are not working. little problem with the maps. we'll get it fixed there. is highway 4 bay point. no major problems here. you can see we already have a little bit of slow traffic coming up to the bay point area. and it's already slow. so it was light, but all of a sudden now we do have some slow traffic. also the morning commute on westbound bay bridge westbound traffic looks a little bit slower at the bay bridge toll plaza. driving to interat a time 880,

this traffic looks good in both directions and so does highway 580 headed west. 6:08. back to steve. >> thank you. good morning. happy friday everybody. cold out there for some. took a little while, but now 30s are popping up and you knew they would. closer to the coast, upper 30s and 40s. jet stream staying north for now. by this time next week, it will be over us. but we hole on to the dry pattern. 30s and 40s for many in the mornings. hazy, a few high clouds. and i have to think fog will work its way back, more moisture in the atmosphere today than yesterday. system that's clipping to the north. not doing much, just headed up into washington and oregon. and i can't find a breeze. i can find 30s now. fairfield and dipping a little bit from last hour. but 54 in san francisco.

welcome back. the family of moammar gadhafi will file a war crimes complaint against nato for the death of moammar gadhafi. it was a nato air strike that hit the convoy he was traveling in last week. and now he survived the air strike, but died later when attackers on the ground shot him. the family says the complaint will be filed with the international criminal court. nato says they didn't know moammar gadhafi was in the convoy when they attacked. yet another survivor rescued from the rubble of sun's earthquake in turkey. a 13-year-old boy. she was trapped inside a shoe shop. relatives say he used a rock and was digging a hole and partially freed himself from the billing. he was not seriously hurt. so far, 570 people are known to be dead after the earthquake. a new report is out that

says california would be hit the hardest by major defense cuts being considered now in washington, d.c. we have the report now, thousands of jobs are on the line. >> reporter: dave, defense contractors in california and across the country are on pins and needles these days and we joust got a report from the industry's association, it projects 125,000 jobs and more than $7 billion in earnings would be lost in california over the next few years if defense cuts on the table go through. now that special bipartisan committee here in congress looking for ways to cut the deficit is deadlocked. and if there's no deal, automatic across the board kick in. the san francisco chronicle reports more than $4 billion is pumped into the bay area each year from defense contractors

with more than 900 local companies selling their products to the military. they project more than a million jobs would be lost nationwide. reporting live from washington, d.c., ktvu channel 2 news. well the u.s. air force is disclosing that it has a new drone base. reaper drones are flying out of a airport in the eastern african country. the air force first admitted the existence to the washington post yesterday. the post reports that the air force is targeting islamic militants. the drones are equipped with hail fire missiles and smart bombs. new time magazine poll is out. it says secretary of state hillary clinton performs better than president barack obama in a new theoretical match-up against republican candidates. the poll shows hillary clinton beating mitt romney by 17%.

beating herman cane by 22%. rick perry by 26%. this is in a hypothetical competition. in comparison, president barack obama leads romney by 3 points. and both cane and perry by 12 in the same poll. clinton has repeatedly said she has no plans of running for president. tens of thousands of former financial backers of president barack obama in his 2008 cam pin are holding back this time. -- 2008 campaign are holding back this time. the president's re-election campaign is not hurting for cash. but he has lost millions of dollars in support from former donors. fund raising for the campaign of republican presidential con tenner herman cane has more than double over the last month. -- doubled over the last month. the campaign has raised more than $3 million over the last

many. cane is now coming in as a front runner competing head to head with romney in most national surveys. election day for san francisco mayor is less than two weeks away. and the campaign money keeps pouring in more mayor ed lee. lee has raised nearly $1.25 million to hang on the his current job. that's nearly double the money raised for the second top candidate. voters go to the polls a week from tuesday. just turning 6:18. temperature in the trial of conrad murray resumes this morning in los angeles. the doctor testified yesterday. he told the court that michael jackson was possibly addicted to demoral and developing a tolerance. that's key to the defense theory that michael jackson needed the drug to sleep. and possibly gave himself the fatal dose of that drug. the defense will wrap up its case today. closing arguments will follow

before the case moves on to the jury. it's 18 minutes after 6:00. back over to sal for a look at traffic. how's the commute? >> busier all over place. as a matter of fact, we are looking at slow traffic beginning in some areas already. not on 880. but highway 4, shouldn't surprise you. and here at the bay bridge toll plaza, a slow down in some of the cash lanes and pretty soon, we're going to have a slow down to all the lanes as the lights have been switched on. this morning many the south bay, 280 northbound looks good driving out of downtown through the west valley. no problems on highway 17 coming down from the mountains down to the valley. let's go to steve. >> hang. career skies, temperatures 30s, 40s and 50s. warmer, but cool. just a pouf of a breeze for some. not too much. a little bun -- just a puff of a breeze for some.

not too much. so that haze is in the forecast. high pressure is going to give us a nice day and weekend. although the lows are cold. in the 30s. a lot of mid-40s today compared to last couple of days. so temperatures about three to five degrees warmer for most. everything is going up and over in the pacific northwest. a few high clouds might drift by. sunny, mild to warm. cold morning for many, so layers here. nice in the afternoon, not bad. but out of the house, it's darn cold for some. 60s and 70s on the temperatures. monday will be cooler but dry. and cooling starts tuesday and rain towards the end of next week. the fish you think you're buying may not be the fish you're actually getting. consumer reports revealed that 22% of the seafood it tested in

supermarkets, restaurants and fish markets in three states is either mislabel, incompletely labeled or misidentified. now the investigation took place in new jersey, new york and connecticut. consumer reports says mislabeling can cause serious health issues if someone is allergic. the fda says it's illegal to mislabel food and it is aware of the problem. cold play fans will have to go to itunes or into a store. the band has decided to withhold its new album from streaming services. those services charge a monthly fee for unlimited streaming and cold play is the biggest band yet to shun the services that pays artists less than a penny for zonk each song played. one of the best golfers in the area. >> right. >> but change is coming to the world of golf. what is comology the rule book that you will need -- what is coming to the rule book that you will need to know before

bay bridge toll plaza, backed up to out to the 880 overcrossing and the metering lights are on. time now 6:24. interstate 5 open again after a pursuit that turned to into a shootout there. started yesterday morning when the driver of a van wouldn't stop at a check point. once officers stopped him with spike strips, police say he started shooting at them. officers fired back and they wounded the suspect. part of the highway was closed down and that stalled traffic out there for hours. wells ago from 21 law enforcement agencies busted six men yesterday for allegedly having child pornography. the sheriff's department says the agos searched the web for people who were downloading child porn. they tracked them down after serving their internet providers with search warns. the department says detectives found bomb making materials as

they searched one home. medicare fraud is getting a closer look from federal investigators here in the bay area. the special agent in charge of the health and human services investigation unit tells us here that the recent prosecution of a suspect is part of a larger crack down. he is serving prison time for using stolen patient identities to get medicare discounts on prescription drugs and then sold the drugs to organized crime rings 9 aa steep profit. he says there are about a dozen similar cases open in the region. in colorado, shelters are now set up to help people stay warm after a snowstorm helped people stay warm. neighbors states are coming in to try to help.

right now, the power outage is affecting about 24,000 homes. well san francisco's civic center will be covered with snow this weekend. a snow boring competition called the downtown throw down scheduled for tomorrow. it's just like the ice or air competitions held in the city. but it's organized by a different group. 25 professionals, ouch, professional snow borders will compete for $10,000 in prizes and admission is free. starting january 1st, golfers will have to get used to two new rule changes. the rules will affect everyone from kids to professionals. yesterday the supports ruling body announced that golfers will no longer be penalize fort lauderdale the wind moves their ball while their club is near it. golfers will be able to smooth sand as long as it doesn't help their shot. got that, pam? and the official rule book has grown to 155 pages from the

night. >> go home! . >> reporter: the mayor had come to speaking to occupy oakland. instead, she had to retreat into the state of city hall. that following people still upset over what happened in oakland on tuesday night. issue issued a statement saying, we are deeply saddened about the outcome on tuesday. it was not what anyone hoped for. it was my responsibility and i apologize for what happened. >> we're here tonight because of scott olsen. >> reporter: about a thousand people gathered here last night to think about scott. on tuesday night, the war vet suffered a fractured skull. he was hit in the head by a projectile that came from behind a police line during a protest. the scene made national news and has inspired a petition

calling on the mayor to drop charges against arrested community leaders. out here, they may be em bodenned by what happened tuesday night. they may be thinking that police are ready to move in because of that incident. next week, there's a special meeting called for tuesday. and one of the city council members that emailed me talked about reviewing what happened in oakland. in 2003, when a similar incident happened, some long shore men down on the port of oakland. reporting live in oakland, ktvu channel 2 news. well in other news, a union representing new york police officers is threatening to take action against occupy protesters who injure police officers. hundreds of protesters marched from their encampment to city hall on wednesday to show solidarity with prokers here in oakland. the scuffles did break out. the president of the sergeants

association reportedly claims that 20 officers have been hurt in occupy related protests. he threatened to file lawsuits against individual protesters. >> about 30 protesters arrested overnight in nashville, tennessee have been released now. the sheriff's department says a night court judge wouldn't sign the warns. they did not say why the judge refused. but state troopers did move in just after 3:00 this morning using a new policy that set a curfew for the growns. protesters had been camped out there for about three weeks. back here at home, school officials say a threat has been made against an elementary school. stay right here with us. in just ten minutes, we will go live to the school to find out what's being done to make sure kids are safe and where the threat is nothing new. the search continues for a

man accused of assaulting a female student in the parking garage at the college. take a look at this police sketch of the suspect. described as a white man about 5 feet 4 inches tall with extremely blond hair. he was wearing a green sweater as well. a 19-year-old woman told authorities she was choked unconscious about 8:30 yesterday morning. she says a man asked ho help fine his car. and he asked her for a hug. when she said, no. he then grabbed her and then cause her to pass out. >> we want everybody aware that there are people that will attempt to gain your trust and could possibly assault you, maybe rob you, or possibly sexually assault you. >> now the unidentified victim says she woke up and found people standing over her. but the suspect was gone. authorities aren't saying which of the two campus parking garages that assault occurred in. police are going to try

something new in their fight against prostitution. the department plans to send dear john letters to people suspected of soliciting prostitutes. now the herald reports a police lieutenant told a community meeting that officers will track people down by vehicle license plates, but first, they'll try to get as much information as possible before sending out the letters. well a major milestone is being marked in just a couple hours from know on the new bay bridge. we are live now in oakland. and we have all the details and a look at that time piece that's being put into place this morning. >> reporter: yes, good morning. you can see on this diagram, segment 14w, the last piece of roadway on the span. it is now on its way to the bridge. it just left the pier and we got video of it taking off. the crew about 20 minutes ago was getting ready to leave the dock. and it should be about a 45 trek across the bay to the bridge where a crane is waiting

to lift this in place. this piece, over a thousand tons. it should be done by this afternoon. this is a major milestone for the project. and we talked with the spokesperson about getting piece in place. >> it's challenging because it's one of the smaller, but heavier piece. it's the last one. so it has to fit tightly up against the skyway that's been waiting for it. and the pieces that have just been put in place. and it's also the piece that receives the main cable of the bridge. so it was a complex piece to build. >> reporter: this is video we shot this morning of the span, the lighted cat walk. you can see where the cable is going to go in place. and live, this is what is in that piece. and this cable actually goes up and through around your t island and back through. what makes it significant is that it's one cable. the golden gate bridge, it's

got two. this new bay bridge being a engineering marvel. more about the cable and how it's all going to hook in copping up. want to go back in and check in with sal on the morning commute. >> well, looking at the bay bridge toll plaza. and looking to see what it looks like. it is backed up for about a 15 to 20 minute wait. it is backed up for a longtime. getting onto the bridge, finally does get better. also this morning, we're looking at interstate 880 in both directions here. it's a nice looking drive. 580 is not bad from high street out to the curve and beyond that to 980. and a lot of people go to the bay bridge. and san jose, 280 through downtown, not a bad trip. 85 is getting slow as you drive in this morning. nothing major, but some brake lights here and there.

6:38, let's go to steve. >> thank you. and very good morning to y'all. cold for some. clear sky, not a puff of a breeze. every reporting station says calm. and looks like weather-wise yesterday, and today will carry us into the weekend, probably increase in some of the fog. it's getting close, more moisture, but looks good and dry. temperatures in the afternoon, mild to warm. cooler pattern next week starts probably if not tuesday, wednesday. and now both the forecast models i looked at brought rain in next thursday. so speeding things up. we will see if that holes. it does not always work. but one rule of thumb, new month, new weather pattern. and i think it will towards november. we're due. pattern though is very content to just hang around and do what it's doing. cold low for some. 30s nap pa. down to 41 redwood city. but some low 50s with 54 in san

afternoon highs into the week wednesday the temperatures about the same. and cool down monday, and then dry. and tuesday looks like getting into the cooler pattern. well, speaking of cooler. ski season is returning. take a look. the mountain resort plans to open one lift at 3:00 this afternoon. depending on the conditions. yesterday evening, a manager tweeted that the snow is getting groomed out and should be ready. last season's near record snow fall kept some resorts open until july. >> they're waying for it. >> yes, they are. for the first time in nine years, the world series is going to a game seven. >> in the air to right center. this game is tied. >> those cardinals set an incredible come back against the rangers. the thrilling ending to an instant classic.

good morning to you. welcome back. a quick look right now at 6:44. last nigh, look at this, the oakland mayor planned to speaking to hundreds of occupy protesters outside oakland city hall. but they jeered and booed her

before she ever got a chance to speaking. the mayor then issued a written statement apologizing for this week's violent confrontation between the police and the protesters. a major section of the new bay bridge is due to be completed today. later this morning, crews will start laying down the final section of the new deck. the bridge is set to open to commuters in 2013. and the defense secretary says new defense cuts will mean the loss of thousands of defense related jobs. they say california will be hit the hardest by those cuts. a scary story this morning. police are investigating a threatening letter. someone sent the letter yesterday to the elementary school. we are there on campus and this is not the only school in the school district that received a threat this week. >> reporter: that's right. three schools also received threatening letters this week. more on that in a minute.

first, i want to show you, this is the elementary school in pleasant hill. they received a threatening letter on thursday morning and we've been told that parents have been informed about it. now we don't know the nature of the threat in the letter sent to this particular school. we are waiting to talk to the police unit to see if they can release more information. but we do know that police are working with martinez police on the threat made here and the threat made at three other schools to see if there's similarities. on wednesday, police sent a release notifying us that three different schools in the city, two private and one public received threatening letters this week. and mrs. were vague about what kind of threats made there. they describe the letters received by the schools as quote, making graphic requests from young children. but this may be a trend. last week, someone sent a threatening fax to concord high school warning that someone would be shot.

fortunately, that threat never materialized. but a week before that, someone sent a threaten email warning of violence. and a student at a walnut creek elementary school received a drawing that included a death threat. we are waiting to learn more about the threat. the school did tell parents that they can expect to see extra security here when school starts about two hours from now. and an attorney for the los angeles dodgers is hinting that the injured giants fan brian stowe might be responsible for his attack. the attorney made the suggestion yesterday to espn los angeles say, quote, it takes two to tan go. the-- to tango. the family attorney immediately responded to the accusations and they say they have witnesses saying the suspects were throwing beer at people and yelling obscenities.

welcome back. dow jones down 30 points this morning to 12,177. good earnings report from chevron. our time now, 6:55. there are signs that more and more business owners are getting fed up with the occupy protest. one business woman, this woman here says the protest put her out of business. the coffee shop owner says she supported the protest in the beginning, but not anymore.

>> you have made me close my business because of your threats and violence and our anger. you never supported us. every morning i was threatened and i could not come to my place of work and my family and i are out of business. >> now the owner says the protests have scared away most of her customers and she says their occupy camp is a filthy hazard to public health. the city of san francisco plans to appeal a federal judge's ruling striking down most of the city's new cellphone law. yesterday the judge ruled that the ordnance requiring dealers to warn customers about possible radiation danger goes too far. he has ordered the city to stop requiring stores to post warnings on their walls. the judge says the warnings are untrue and misleading. two bay area cities are list add among the stop spots for halloween and trick-or- treating. san francisco was named the best city for the tradition. san jose ranks number sixth.

the list was put together by the real estate website zillow.com. they base it on home index, population and where trick-or- treating requires the least amount of walking. a group wants to make sure kids stay safe this halloween. working partnership usa, they'll hand out 40,000 glow necklaces as part of a pedestrian safety campaign. the give away will take place between 4:00 and 7:00 p.m. in san jose. the kids who show up in costumes, they'll also get free gifts. >> a nice idea to wear something glowing. so cars can see the trick or treaters. right? >> absolutely. >> great decorations and go running. >> just be careful out there. good morning. let's go out and see what we have with the morning commute. we have slow traffic on highway 4 which is typical.
